The general terms are at the end of this tab. Read them first, then return to the conditions. A service’s terms are on that service’s tab. If this text differs from the Russian text, the Russian text prevails.

The more specific terms of a particular service prevail over the general terms.

Basic rules

If you are under 18, or you do not meet the status of a User, stop using the services immediately.

If you do not agree with a clause, stop using the service that clause applies to. If the clause is general, stop using both services and the showcase.

Which services this document covers

This document applies to:

General clauses apply to both services and to the showcase where they can apply to it. The showcase does not sell paid services: payment takes place on the relevant service, and the seller’s status is shown on that service’s payment page.

The Language Filter tab applies only to LF and LF API. The Random Data tab applies only to RD and RD API. The specifics of one service do not change the terms of the other.

Acceptance

Visiting the showcase https://statusnick.com means viewing the showcase. Acceptance of a particular service follows the rules of that service. Acceptance is by conclusive conduct (акцепт конклюдентными действиями).

Changes to the terms

The Administration may, with no prior notice, change:

  • this document;
  • tariffs;
  • the price of services;
  • the internal rate;
  • functionality;
  • API methods;
  • limits;
  • bonus programs;
  • payment methods;
  • the procedure for access.

A new edition takes effect when it is published on the showcase. Continued use after publication means the User agrees, within the acceptance rules of the service the User is using. For Random Data, the procedure for unilateral changes is described on the Random Data tab, in the acceptance section.

Information on the site

Any information on the showcase and on the service sites, other than the mandatory terms expressly stated on this page:

  • is not a public offer;
  • is not a guarantee of a result;
  • is not a promise;
  • is informational, approximate, or demonstrative.

Contacts

Contact the Administration at info@statusnick.com, https://t.me/statusnick_user, and the contacts page of the service you use. Journalists, bloggers, and influencers use the same contacts.

No duty is accepted to answer every message. That does not cancel the claims procedure in the disputes section.

Cookies and similar technologies

Cookies are small text files that the browser stores on your device. They exchange data between the device and the server and allow actions and preferences to be remembered. They are local files on your device, not a transfer of your personal data to us. Third-party applications may set their own cookies. Besides cookies, the browser’s local storage and other ways of storing data and interacting with your equipment and programs are used.

Cookies, local storage, and similar technologies are used for:

  • sign-in;
  • saving settings;
  • statistics;
  • security;
  • correct operation of the services.

Persistent cookies are used in the main. They remain after the browser is closed, so the site can recognize you on a later visit and restore settings.

How this is applied:

  • Analytics and third-party services. Third-party tools, for example Yandex Metrica, collect depersonalized visit statistics. Cookies may also be set by the content-management system or by the provider’s equipment to keep the service stable.
  • Functionality. Signing in to an account and saving interface settings, including the state of disclosure widgets and the display mode.

Technical cookies are required for sign-in and settings. You can clear cookies or block them in the browser settings.

Important: if cookies are blocked, some functions may become unavailable and your personal settings will be reset.

Mentioning the services

If a service is mentioned without a separate advertising contract or a partner-program agreement, no one may claim a reward of any kind.

Restrictions on use

It is forbidden to:

  • interfere with the operation of the services;
  • create an excessive load, provoke a failure, damage, interruption, shutdown, or restart, or hinder other users;
  • bypass, disable, impair, or obstruct protective measures;
  • use viruses, trojans, worms, logic bombs, and other malware;
  • use software to automate or modify the services;
  • reverse engineer, decompile, or otherwise attempt to obtain source code, algorithms, structure, or organization;
  • parse and copy the site, including automatic, manual, and semi-automatic collection of HTML markup and form responses which, bypassing the API, would allow anyone to:
    • create a similar data set: libraries, dictionaries, parameters, and the like;
    • provide the same services to third parties;
  • use, for registration and sign-in, telling email addresses that contain part of a name, a surname, a city, an age, a year of birth, a company name, or similar information.

The Administration may restrict access if a violation is suspected.

Confidentiality

Third-party analytics may be used, for example Yandex Metrica. Aside from metrics, the Administration does not intentionally transfer to anyone information about which services are provided, what content arrives, what was found in it, what the balance is, and the like.

Finance

Before paying, the User confirms that the User:

  • registered and signed in;
  • received bonus balance and checked the service;
  • assessed the quality and functionality;
  • has read the price on the day of payment and accepts that the price may change with no notice and no warning.

Fees of banks, payment gateways, and intermediaries are paid by the User, unless stated otherwise.

The Administration may grant individual and mass discounts with no duty to grant them to everyone.

If there is no financial activity for 12 months, unused balance may be set to zero. For Random Data, an additional representation by the User is on the Random Data tab.

Disclaimer of warranties

The services and all services provided through them are provided at your risk, as is and as available, with no express or implied warranties, and with possible technical limitations.

There is no warranty of:

  • completeness, security, reliability, quality, accuracy, and availability;
  • uninterrupted operation;
  • absence of errors;
  • fitness for expectations;
  • a commercial result;
  • compatibility with all systems.

Limitation of liability

The Administration is not liable for:

  • direct and indirect loss;
  • lost profits;
  • loss of data;
  • acts of third parties;
  • blocks;
  • communication failures;
  • DDoS attacks and other attacks, and their consequences;
  • hosting errors and technical problems;
  • wrong decisions of the User;
  • consequences of using the results of the services;
  • other unavailability that is not directly connected with the activity of the services.

The Organizer of the services, licensors, service providers, employees, agents, and officers are under no circumstances liable for any damage arising from or in connection with the use of, or inability to use, the services, their services, or related websites. This also covers any content on the services or other websites, and services or goods obtained through the services, including direct and indirect loss such as moral harm, loss of income, profit, business, reputation, or data, even if such consequences were foreseeable, whether caused by a delict, including negligence, by breach of an agreement, or otherwise.

The Organizer, licensors, service providers, agents, and officers are under no circumstances liable for an act or omission of the User.

The Administration is not liable for how the User uses the service.

This clause does not affect liability that cannot be excluded or limited under applicable law.

The maximum liability for Language Filter and for Random Data is limited to the sum of the User’s payments over the last 30 calendar days for the service in connection with which the claim is made, unless mandatory law provides otherwise.

Force majeure

The Administration is not liable for non-performance or delay caused by circumstances beyond reasonable control, including:

  • wars, sanctions, terrorist acts, revolts, embargoes;
  • acts of the state or of civil or military authorities;
  • loss of communications;
  • fire, flood, accidents, epidemics;
  • strikes, shortage of transport, fuel, energy, labor, or materials;
  • mass technical failures;
  • cyberattacks, third-party DDoS attacks, and their consequences;
  • problems of the hosting provider;
  • other similar circumstances.

Disputes

The procedure in this section applies to Language Filter and to Random Data.

In a dispute, claim, disagreement, or question about use of the services, payment, access to an account, results of processing or generation, interpretation of this document, or other relations, the User first contacts the Administration through the contacts stated above.

The parties in good faith take reasonable steps toward a peaceful settlement: negotiations, exchange of messages, explanations, and documents.

The time for considering a request is up to 30 calendar days from receipt, unless the nature of the request or the law requires another period.

Before going to court, the User provides enough information to identify the situation: account data, the date of the events, a description of the demands, and supporting materials.

If the dispute is not settled before court, it is resolved under the law of the Russian Federation at the location of the Executor (Исполнитель), unless a mandatory rule provides otherwise.

Claims with information known to be false, abuse of right, multiple duplicate requests, pressure, threats, insults, and artificially creating a dispute are not allowed. The Administration may use this as evidence of a party’s bad faith.

Terms

Showcase — the site https://statusnick.com, which links to the services and to this page.

User — any person who has reached the age of majority, who is regarded as biologically alive, and who, in dealing with the services, directly represents that person’s own interests or the employer’s interests, acknowledges the force of the laws of the Russian Federation, and acts in accordance with them.

Personal data — any information relating to a directly or indirectly identified or identifiable natural person.

Cookies — small pieces of data stored through the browser on a computer or mobile device. They contain information about actions on the site and may include data about the device and the time and date of the session. Cookies are stored locally on the device.

We, administration, owner, developer, organizer — ways of naming the person who holds the rights in the services and sets the rules. That person may act through employees in a formal employment relationship who have the corresponding authority.

Executor (Исполнитель) — the seller of a particular payment, as stated on the payment page of the service the User is using.

Our Services — when capitalized, the service the User is using: for Language Filter, LF and LF API; for Random Data, RD and RD API.

Bonus balance — an amount of internal currency that the service provides for testing, for setting up ПТС, and so that the User can check the quality of the services before real payment.

Internal rate — the ratio of money paid to the amount credited to the balance, excluding deductions of intermediaries such as banks and crypto exchanges. Each service has its own name for the internal currency.

Account — a set of data joined, in the relevant service, by a unique record of the User, through which the User’s acts and omissions are recorded.

Purpose

The service is created and intended mainly for:

  • entrepreneurial activity;
  • professional activity;
  • commercial activity;
  • software development;
  • administration of digital products;
  • process automation;
  • checking and processing data for work.

Language Filter is not aimed at household, personal, family, or domestic consumption.

By using Language Filter, the User confirms and represents that the User:

  • uses the service in connection with earning income, work, business, or professional tasks;
  • does not purchase the services for personal, family, or household needs;
  • understands the technical and professional nature of the service;
  • has the knowledge needed to use the API and related tools;
  • independently assesses whether the service is fit for the User’s purposes;
  • bears the risk of choosing the service wrongly.

If these representations are untrue, the User bears the risk of the consequences.

The User agrees that the professional nature of Language Filter is confirmed, among other things, by the following:

  • API access is provided;
  • limits, tariffs, quotas, and technical parameters are used;
  • integration into software products is allowed;
  • organizational credentials may be used;
  • payment for business purposes is possible;
  • the services concern data processing, not household consumption;
  • the result of use depends on the User’s competence.

Acceptance

Full and unconditional agreement to the Language Filter terms is any of the following:

  • visiting https://lf.statusnick.com;
  • registering an account;
  • signing in;
  • using demo functions;
  • receiving bonus balance;
  • topping up the balance;
  • sending requests through LF API;
  • continuing to use the service after the terms change.

Mentioning the service

A text link is allowed:

The service’s designations, screenshots, interfaces, logos, video, neural-network generations, and other derivative materials are allowed only with the written consent of the right holder, unless the law provides otherwise.

Restrictions

In addition to the general restrictions, for Language Filter it is forbidden to:

  • copy the database, responses, dictionaries, and parameters;
  • create a similar or competing service based on the results of the service;
  • use the service for unlawful purposes;
  • use the service for fraud, manipulation, or speculation.

Confidentiality

Data sent to LF API are processed in the volume and for the time needed to perform the particular request. A brief presence of data in the memory of the equipment while it is processed is not storage in its own right.

When the public demo form is used, the following may be stored:

  • the text of the request;
  • the check result;
  • technical headers;
  • information about the device;
  • error logs.

This is used to improve the quality of the work. These clauses do not apply to the demo form in the account.

For a Language Filter account, the following may be processed:

  • a password hash;
  • an IP address;
  • an email hash;
  • the sign-in date;
  • integration identifiers;
  • the history of operations.

Finance

The price is the tariff in effect at the moment the particular service is actually rendered. Topping up the balance does not lock future prices.

The service may use a settlement unit, LF. The Administration sets the rate at which money is converted into internal balance, and the rate may change. Movement of funds for services is in the internal currency. The User accepts the risk that the price will change.

Terms

LF — the site https://lf.statusnick.com, excluding embedded third-party blocks, for example metrics counters and iframes of polls or comments, and excluding https://lf.statusnick.com/api: technical requests are processed there, and the site does not operate there.

LF API — the program code at https://lf.statusnick.com/api that processes incoming requests and returns a result. It has no visual design.

Detection method — a set of algorithmic actions which, in the context of the service, find in the transmitted data: (a) a deviation from an expected value; (b) a match to an expected value. The purpose is to find, in the User’s data, occurrences of information units — letters, digits, punctuation, symbols, words, and sets of them — that match criteria set by the User or by LF API. For example, the action “check duplication of letters in the word ‘метооод’” checks, as both a deviation and a match, an expected value of the letter “о” repeated n times. Put otherwise: the word “метооод” has two extra letters “о”, which is shown by the lack of meaning in forms other than “метод”, such as “метд” or “метоод”. The number of extra letters “о” is determined by comparison under the formula xxxxxxxxxx, which sets a reasonably allowable number of variations of the word “метод”, where the number of occurrences of “о” in the position found could still be justified and carry meaning. The processing result reflects how the owner-developer would have reached the same result manually, by that person’s own thinking. This remark matters: it discloses the substance of the service, that is, what the User pays for, explains the subject of copyright and of a utility-model right, and characterizes the quality of the detection methods. The detection methods are protected by the laws of the Russian Federation.

Processing — manual and/or computer application of detection methods to the User’s data.

Language Filter service — processing of the data provided, whether or not there is a result.

LF internal currency — a unit of balance previously converted from ordinary money at the internal rate. The User receives Language Filter services only for that unit.

Language Filter seller — a person with citizenship and/or a physical location in the Russian Federation, in the status of a natural person, a self-employed person (самозанятый), a sole proprietor (ИП), or a limited liability company (ООО), depending on the type of services, the method, or the amount of payment, who provides services for a fee by means of the service. The exact status is shown before payment on the payment page: it depends on the type of transfer, the amount, and the method. Self-employed, payment purpose “data processing”: full name and INN (tax ID). Sole proprietor: full name and INN. Limited liability company: name, INN, OGRN, and legal address.

Purpose

Any person may use RD API for that person’s own earnings, with no duty to mention the service and with no extra payment beyond the price of the services.

Acceptance

A User who uses addresses beginning with https://rd.statusnick.com unconditionally accepts the Random Data rules and undertakes to follow them. Otherwise the User must leave the service immediately.

The information in this document, the terms of Random Data, and the rules may change with no warning and no notice. This is an essential condition. A unilateral change after acceptance, under Article 310 of the Civil Code of the Russian Federation, is not allowed from a person engaged in entrepreneurial activity toward an individual. At the same time: (a) Random Data acts on behalf of an individual; (b) under Article 424 of the Civil Code, a change of prices and a number of other conditions are allowed toward individuals in respect of newly introduced services, tariffs, in-service rates, and subscription charges. Toward the other parties to the agreement, unilateral changes are allowed once the terms have been accepted. Acceptance of Random Data is a legally significant act, namely topping up the balance.

Mentioning the service

Without further approval, a mention by the link https://rd.statusnick.com or rd.statusnick.com is allowed on pages of sites about computers, programming, computer games, literature, and film production.

With a mandatory notice, but without further approval, unless other placement rules say otherwise, the same link is allowed, including as text in a printed publication, inside works, if the purpose of the link is to disclaim liability for a match between generated data and real data. For example, a film character was generated by the service, and a full or partial match appeared with real people, their biometrics, or a psychological portrait. To avoid misreading, stalking, and other consequences, a link to the service may be given, including a link to the specific generation result.

Without the Organizer’s approval, Random Data may not be mentioned in other ways, in whole or in part, including as a name, an abbreviation, a transliteration, or part of a site name. Other ways include, without limitation: screenshots, photographs, video, sound, holograms and stereography, encoding including a QR code, baked goods, laser projection, gestures, skywriting, and the output of generative tools, including neural networks.

You may not publish, about the service, its users, or the administration, information that is provocative, contradictory, erroneous, or confidential, or information that became available because of a technical failure or a human factor on the side of the administration or of third parties whose services the administration uses.

You may not mention the service next to, in one visual, sound, or olfactory block with, negative phenomena and events, or in unlawful situations. For example, you may not publish material about the service next to material about armed conflicts, discuss the service in a program about abortion or murder, write the link on waste containers, or write the name on a dog.

Search engines and bots are forbidden to collect information for generative mechanisms, neural networks, and recommendation technologies: such systems may join information in a forbidden way and assemble, guess, or select a set of personal data, including from behavioral factors or a likely combination of data. The Administration reduces this risk by ordinary settings of special files and by other settings. The site is made for people, not for search engines and bots.

Confidentiality

RD receives the data the browser transmits. RD cannot technically or physically refuse an IP address, regional data, the page address, browser information, and other data: the browser and the server on the user’s side transmit them before the page opens. Turning that transmission off, or substituting it for confidentiality, is the user’s own matter. That is how the network, HTTP, and the internet work.

RD API works the same way, except that it does not receive browser data, including screen resolution, mouse actions, and cookies.

RD does not collect or store personal data. A natural person cannot be identified, directly or indirectly, from the data transmitted. An IP address identifies a device, not a user. Accuracy of personal data by IP address, in the sense of Article 5 and item 6 of Federal Law 152-FZ, would require the provider’s closed information and, at the same time, a decision of an authority.

RD does not store users’ email addresses. Email is therefore not used for internal purposes or for sending notices.

An IP address is stored at registration and sign-in for security, load distribution, and other cases. Stored addresses are shown in the account: the last N records are kept and are replaced as new sign-ins occur.

The User must not use Random Data from the User’s real IP address. Some courts in the Russian Federation treat an IP address as personal information. The Random Data administration is not an operator of personal data and does not agree that an IP address is personal data: the address may be dynamic, a computer-club address, a static address of a device temporarily used by another person, a substituted address, a proxy address, or an address assigned because of bad-faith acts of third parties.

By continuing to use Random Data, the User confirms that the User hides the real IP for confidentiality, not in order to evade anything, or uses another way of hiding the User’s personal data. Otherwise the User must leave Random Data.

Generation results

A match between a result and real data is highly probable. Results must be used with care. Any match is accidental.

The User understands that, because of randomness, a result cannot be read as an insult on any ground, as an attempt or a wish to cause physical, technical, psychological, or other harm, or as an intention to influence decisions or change an opinion. An exaggerated example: a name generator may assemble the units “и”, “д”, “о”, “т” into a word which, in the User’s language, reads as “idiot”. That is not a probable name and not an intention; it is a random assembly. The same applies to the password generator, the identity generator, and the other generators.

The User must not use results to cause harm or loss, directly or indirectly, to anyone.

Results that are not subject matter of copyright, in most cases numbers, passwords, lottery combinations, and the like, and results created by neural-network technologies, may be used without payment.

A result that has the features of subject matter of copyright may be used by the User for commercial and non-commercial purposes with no extra payment, if it was obtained from an account that was paid before generation. Then, under Article 1291 of the Civil Code of the Russian Federation (Federal Law 230-FZ), the result as subject matter of copyright passes to the User. For example, a generated identity may be used in a book or for the User’s own users’ accounts only if, before generation, the RD balance was topped up by at least the price of that result.

In all other cases, including generation without registration and sign-in, generation paid from bonus funds, and generation with a negative balance, the result is a service at the expense of the service owner, with the owner’s corresponding rights in the result, or with the User having no such rights.

Use of a result that has the features of subject matter of copyright, without a paid account, has consequences under copyright law and, in the case of abuse, additionally under criminal law.

Finance

The User confirms that the preliminary check and test were satisfactory.

The User warrants that the topped-up balance will be fully used within twelve months, whatever the price of the services is at the moment they are purchased. If the balance is not used within that period, the Organizer may set it to zero because the warranted financial activity did not take place.

Receipts:

  • A receipt can be obtained if the corresponding setting is chosen before the pay button is pressed. At the payment system’s request, the User provides personal data on the payment system’s side, not on RD’s side: phone number, email, and full name. The receipt can be declined with the same setting.
  • When paying as a legal entity, the entity’s details are filled in beforehand in the account settings.
  • Preparing a receipt takes time: the payment system may delay it, and in some cases it is created manually.
  • The receipt is provided as an image by a link and can be saved with the browser. The link is shown in the account, in the finance section, in the orders and receipts block.

The internal currency RD is the same throughout the service and may or may not match a face amount in Russian rubles. Depending on the price in a given period, 1 ruble may buy 10 units or 0.1 unit. Movement of funds is calculated in the internal currency.

On payment, a payment-system fee is generally withheld, including on the Administration’s side and possibly on the User’s side. That is why the button says “Pay” (“Оплатить”) and not “Top up” (“Пополнить”).

Terms

RD — the site https://rd.statusnick.com, excluding embedded third-party blocks, for example metrics counters and iframes of polls or comments, and excluding https://rd.statusnick.com/api: technical requests are processed there, and the site does not operate there.

RD API — the program code at https://rd.statusnick.com/api that processes incoming requests and returns a result. It has no visual design.

Generation result — a set of information units: bits, letters, digits, symbols, words, sets of words, and others, which RD API has assembled into one result in a regular-and-random way that reflects how the owner would have made that result manually, by the owner’s own thinking. Randomness affects which units are selected. Regularity describes how those units are formed, the rules for joining them, and is an essential part of RD API.

By that nature, a generation result is subject matter of copyright if it was created without neural-network mechanisms and has artistic value, uniqueness, and/or other signs of authorship. For example, an uncommon name, an identity of a book character, or the title of a work. Generated passwords, numbers, lottery combinations, and the like in most cases have no artistic value or uniqueness, so authorship may not extend to them.

Random Data service — creating and providing a generation result or results.

RD internal currency — a unit of Random Data balance. Whether it matches the Russian ruble is set by the internal rate and may differ from a face amount.

Random Data account — the property of RD. It includes, among other things, finance statistics, generated results, login, password, codes, hashes, sign-in history, and other User data joined by a unique identifier.

Random Data seller — a person in the status of a natural person, a self-employed person (самозанятый), a sole proprietor (ИП), or a limited liability company (ООО), depending on the type of services, the method, or the amount of the payment or donation, who provides services for a fee by means of the service and accepts a payment or a donation for the development of the project. The exact status is shown before payment on the payment page: it depends on the type of transfer, the amount, and the method. Natural person, purpose “donation”: first name and patronymic. Self-employed, purpose “data processing”: full name and INN. Sole proprietor: full name. Limited liability company: the organization’s name.
